Je m’attendais à voir un commentaire dans le rapport de gestion mais il ne semble pas y en avoir non plus (j’ai survolé rapidement).

Quoique c’est un peu surprenant qu’il n’y ait AUCUN commentaire, je ne m’attendais toutefois pas à lire quelconque information nouvelle pour l’instant puisqu’il n’y a eu aucun développement dans la poursuite.

Xpel s’est fait servir la poursuite de 3M le 23 mars 2016 seulement et a 21 jours pour répondre.

After reading the 263 patent history, here’s my understanding:

3M’s patent claims:

A multilayer protective film comprising:

1- a first layer comprising a polyurethane, said polyurethane being a polyester-based polyurethane, a polycarbonate-based polyurethane or a combination of both; (this is the topcoat/clearcoat)

2- a second layer comprising a polycaprolactone-based thermoplastic polyurethane; (this is the main 6 mil urethane layer)

3- and a PSA layer comprising a pressure sensitive adhesive,

wherein said first layer is bonded to one major surface of said second layer and said PSA layer is bonded to an opposite major surface of said second layer such that said second layer is sandwiched between said first layer and said PSA layer.

The patent examiner rejected twice 3M’s claim. The examiner based his decisions on a previous patent (Fuchs US2006/0127666A1) which discloses a multilayer protective sheet comprising:

1-polyester based polyurethane layer as a first layer;

2-polymeric second layer;

3-PSA layer comprising a pressure sensitive adhesive.

Where each layer is bonded to each other in the same way as 3M’s patent.

BUT, the Fuchs patent fails to disclose that the second layer is a polycaprolactone based thermoplastic polyurethane as the 3M patent claims. However, the examiner references a patent by Frisch (4741961) where Frisch uses polycaprolactone as an adhesive film to preserve transparency under severe temperature and humidity during the manufacture of laminated glass panes. So it would have been obvious for an ordinary skilled person to use polycaprolactone as the second layer in the Fuchs patent given the Frisch patent.

3M was able to disprove this obviousness. First, 3M argued that Frisch refers to polycaprolactone as an adhesive, and the examiner failed to prove that it would have been obvious to use an adhesive material as the 2nd layer in the film. 3M was also able to prove that transparency under severe temperature and humidity as stated in the Frisch patent is taken in a completely different context than the Fuchs patent (to manufacture laminated glass, not to protect cars), so again it wouldn’t have been obvious for a normally skilled person to use poly in the 2nd layer of Fuchs’ patent.

My take:

It doesn’t appear that the patent examiner looked for existing PPF on the market at the time. All he did was search old patents.

After 3M filed the appeal briefs, the examiner got sloppy in his arguments (in my opinion) and didn’t dig further or bring new information to the table. He sounded like a broken record, repeating the same arguments as 3M was evolving and bringing new arguments.

With a little more effort and digging I think Xpel could find a way to prove that it would have been obvious to use polycaprolactone as the main layer.

It is possible that Llumar was already using that material in its 6 mil layer in 2004. It talks about a 6 mil polyurethane film (see attached spec sheet)

Il ne semble pas que l’examinateur de brevets ait regardé pour des PPF existants sur le marché à l’époque. Tout ce qu’il a fait a été de regarder de vieux brevets.

Après que 3M ait soumis ses mémoires pour l’appel, l’examinateur a bâclé ses arguments (à mon avis) et n’a pas creusé suffisamment ni n’a amené de nouvelles informations sur la table. Il n’a fait que répéter les mêmes arguments alors que le plaidoyer de 3M a évolué et que ces derniers amenaient de nouveaux arguments.

Avec un peu d’effort et de recherches, Xpel pourrait trouver une façon de prouver qu’il était évident d’utiliser du polycaprolactone comme couche principale.

Il est possible que Llumar utilisait déjà ce matériel dans sa couche de 6 mil en 2004. Voir fichier ci-joint: on parle d’un film de polyuréthane de 6 mil d’épaisseur.

J’ai rencontré Ryan Pape (CEO) hier à Toronto. Voici mes notes:

  • Il croit que l’entreprise est possiblement à un point d’inflexion en ce moment en terme de SG&A grâce à tous les processus qui ont récemment été mis en place pour gérer la croissance future.
  • La pellicule de teinte de fenêtres est très bien reçue par le marché et Ryan est confiant que ce produit contribuera éventuellement aux revenus de manière significative.
  • Ils ont consulté plusieurs firmes d’avocats ayant affronté 3M dans le passé et ces discussions ont été très utiles dans l’élaboration d’une stratégie (il ne pouvait pas s’avancer plus loin que ça).
  • Lorsque je lui ai demandé s’il était confortable avec le bilan sachant qu’il y a une possibilité de procédures judiciaires coûteuses, il a répondu qu’il réfléchissait à la possibilité de lever du capital ($1-2M) de manière préventive et pour envoyer le message à 3M que Xpel ne se fera pas intimider.
  • Lorsque je lui ai demandé ce qu’il trouvait que les investisseurs comprennent le plus mal à propos de son entreprise, il a répondu que les gens sous-estiment la force et la durabilité des relations qu’ils ont bâti et du modèle d’affaire.
